UPDATE April 29 2012: Lend Lease submits amendments to plan – bad news for Beatty Ave.

Lend Lease's changes bring to mind a certain phrase...

Rigby Cooke Lawyers (acting on behalf of Lend Lease) will have mailed information to those who have lodged an objection to VCAT (letter dated 3 April 2012) informing objectors that Lend Lease has applied to VCAT to amend its permit application by substituting amended plans for the original permit application plans.

The amended plans make very little change to the plans which have already been rejected by the community. There has been a reduction in height of one of the 12/13 storey towers near the Toorak railway station by 3 storeys, but it still leaves a 9-10 storey building overlooking small houses in Tillotson Terrace.

Beatty Avenue residents will now have a 9 storey tower increased to 11/12 storeys, and residents living in Beatty Avenue will be faced with enormous visual bulk. Generally, the density remains basically unchanged (466 apartments as opposed to 475 apartments). Who’d notice the difference?

Overall, our assessment is that Lend Lease hasn’t responded to community concerns and the application remains unacceptable in all respects. It is simply fiddling at the edges! (We are being generous here.)

SO DO I HAVE TO SUBMIT A FRESH OBJECTION TO VCAT OR COUNCIL?

If you have already objected to the previous plans, you can choose to amend your Statement of Grounds at any time prior to the Hearing (28 May 2012). If you do this, you must provide a copy of your amendents to Rigby Cooke Lawyers, Stonnington City Council and VCAT.  Alternatively, do nothing, and rely on the Statement of Grounds that you have already submitted.

WHAT IF I HAVEN’T OBJECTED YET BUT WANT TO DO SO NOW?

We encourage people who have not previously objected (where have you been all this time?) to do so. Simply complete the Statement of Grounds and provide a copy to Rigby Cooke Lawyers, Stonnington City Council and VCAT by Tuesday 1 May 2012. Here’s the form:   VCAT form B
